PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN IMPORTANT AVIATION AND SAFETY DISCLAIMERS, LIMITATIONS OF LIABILITY, AN AGREEMENT TO RESOLVE CERTAIN DISPUTES THROUGH BINDING INDIVIDUAL ARBITRATION, AND A CLASS ACTION AND JURY TRIAL WAIVER.
These Terms of Use ("Terms") constitute a legally binding agreement between you and Aircraft Authority, doing business as Aircraft Authority ("Aircraft Authority," "we," "us," or "our"), governing your access to and use of AircraftAuthority.com and any related websites, applications, databases, reports, software, communications, tools, marketplaces, transaction features, products, and services made available by Aircraft Authority (collectively, the "Platform").
If you create an account or otherwise affirmatively accept these Terms, you acknowledge that you have read, understood, and agree to be legally bound by them.
If you access or use the Platform without an account, your access and use remain subject to applicable portions of these Terms, including rules governing permitted use, intellectual property, Platform information, disclaimers, and prohibited conduct, to the extent enforceable under applicable law.
If you do not agree to these Terms, do not create an account or use portions of the Platform requiring acceptance.
1. ABOUT AIRCRAFT AUTHORITY
Aircraft Authority operates an aviation information, aircraft-identity, discovery, ownership, history, marketplace, intelligence, data, and technology platform.
Aircraft Authority may provide or facilitate access to information concerning aircraft, aircraft ownership, registration, configuration, equipment, modifications, maintenance, history, value, listings, airports, aviation businesses, professionals, services, transactions, and related subjects.
Unless expressly stated in a separate written agreement, Aircraft Authority is not: the Federal Aviation Administration (FAA), the National Transportation Safety Board (NTSB), a governmental agency, an aircraft registry, an airworthiness authority, an A&P mechanic, an Inspection Authorization holder, a repair station, an aircraft inspector, an engineer, a Designated Engineering Representative, a Designated Airworthiness Representative, a flight instructor, an aircraft operator, a pilot-in-command, an aircraft broker or dealer, an appraiser, an insurer, a lender, an escrow provider, a title company, an attorney, an accountant, a tax advisor, or a substitute for qualified professional advice.
Information made available through Aircraft Authority is intended to be one source of information among others. Aircraft Authority should not be the sole source relied upon for aviation, maintenance, regulatory, operational, safety, purchasing, selling, rental, leasing, financing, insurance, ownership, title, legal, or financial decisions.
2. IMPORTANT AVIATION AND SAFETY NOTICE
AIRCRAFT AUTHORITY DOES NOT DETERMINE WHETHER AN AIRCRAFT IS AIRWORTHY, SAFE TO OPERATE, LEGALLY PERMITTED TO OPERATE, PROPERLY MAINTAINED, OR APPROPRIATE FOR ANY PARTICULAR FLIGHT OR MISSION.
The appearance of an aircraft, component, modification, inspection, maintenance entry, airworthiness directive, service bulletin, configuration, equipment item, verification indicator, report, record, recommendation, or status on Aircraft Authority does not constitute: an airworthiness determination, an authorization to operate an aircraft, a return-to-service determination, a maintenance signoff, regulatory approval, a conformity determination, a professional inspection, a legal determination, or a guarantee of safety.
Pilots, owners, operators, purchasers, renters, lessors, lessees, mechanics, maintainers, and other users remain responsible for complying with applicable laws, regulations, operating limitations, inspections, directives, maintenance requirements, operating procedures, and prudent aviation practices.
NEVER RELY UPON AIRCRAFT AUTHORITY AS A SUBSTITUTE FOR LEGALLY REQUIRED RECORDS, FAA OR OTHER AUTHORITATIVE INFORMATION, REQUIRED INSPECTIONS, QUALIFIED MAINTENANCE PERSONNEL, PROFESSIONAL ADVICE, OR PILOT-IN-COMMAND JUDGMENT.
3. INFORMATION MAY BE INCOMPLETE, DELAYED, OR INCORRECT
Aircraft Authority may obtain information from: FAA and other governmental records, manufacturers, aircraft owners, operators, purchasers and sellers, aviation professionals, businesses, service providers, public records, third-party databases, imported documents, aircraft records, marketplace activity, historical sources, users, automated extraction systems, machine-learning systems, artificial intelligence systems, and other sources.
Despite our efforts to normalize, organize, match, classify, reconcile, summarize, interpret, associate, or enhance this information, it may be: inaccurate, incomplete, outdated, delayed, duplicated, incorrectly matched, incorrectly classified, incorrectly interpreted, based on incomplete underlying records, applicable to a different aircraft or configuration, or otherwise erroneous.
Government records and other source records can themselves be incomplete, delayed, or incorrect. Aircraft Authority does not warrant that Platform information is accurate, complete, current, error-free, or sufficient for any particular purpose.
Users are responsible for independently verifying material information before relying upon it.
4. GOVERNMENT AND FAA INFORMATION
Aircraft Authority may reproduce, organize, display, analyze, enhance, or associate information derived from FAA databases and other governmental sources. Aircraft Authority is an independent private company.
Unless expressly stated otherwise: AIRCRAFT AUTHORITY IS NOT AFFILIATED WITH, ENDORSED BY, SPONSORED BY, OR OPERATED BY THE FAA, NTSB, UNITED STATES GOVERNMENT, OR ANY OTHER GOVERNMENTAL ENTITY.
The presence of FAA-derived or government-derived information does not mean that the government has verified or approved: an Aircraft Authority aircraft profile, an ownership chronology, an Aircraft History Report, a valuation, configuration intelligence, modification information, a marketplace listing, a user, a provider, a transaction, or any Aircraft Authority-derived conclusion.
Governmental records may lag behind real-world transactions or events. Users remain responsible for determining what legally controlling records apply to their circumstances.
5. SOURCE, PROVENANCE, AND VERIFICATION INFORMATION
Aircraft Authority may distinguish among information based upon source and provenance. Information may originate from or be characterized as: government sourced, manufacturer sourced, authoritative sourced, owner submitted, owner verified, user submitted, provider submitted, document supported, transaction supported, Aircraft Authority derived, estimated, inferred, AI generated, automatically extracted, reported, pending, disputed, unverified, or otherwise categorized.
These indicators help communicate how Aircraft Authority understands the information. They do not guarantee its truth or legal effect.
6. VERIFICATION DOES NOT MEAN GUARANTEE
Aircraft Authority may use terms or indicators such as: Verified, Owner Verified, Aircraft Authority Verified, Source Verified, Document Verified, Transaction Verified, Authoritative Source, Reported, Pending, Unverified, Disputed, or similar terminology.
Such labels indicate the type or level of evidence available to Aircraft Authority under the Platform's procedures. They do not constitute a guarantee of: legal ownership, title, absence of liens, airworthiness, condition, safety, regulatory compliance, authenticity of every underlying document, absence of fraud, value, merchantability, fitness for a particular purpose, or correctness of every related data point.
Verification methodologies may evolve.
7. AIRCRAFT OWNERSHIP INFORMATION
Aircraft Authority may permit a user to: claim an aircraft, identify an ownership interest, establish an ownership relationship, submit documentation, report an aircraft acquisition or disposition, accept an ownership transfer, dispute an ownership claim, or otherwise associate an account with an aircraft.
Aircraft Authority may maintain ownership as a chronological, provenance-backed history rather than a single mutable field. Government records may lag behind transactions known to Aircraft Authority.
An Aircraft Authority ownership designation is not: a title opinion, title insurance, an FAA registration determination, a lien search, proof against all competing ownership claims, a judicial ownership determination, or a guarantee of legal ownership.
Anyone submitting an ownership claim represents that they are authorized to do so and that information supplied is truthful to the best of their knowledge. Aircraft Authority may: request supporting documentation, reject a claim, approve a claim, change a verification status, suspend a claim, investigate a discrepancy, preserve disputed information, maintain historical ownership events, associate source provenance with claims, and restrict accounts that submit fraudulent information. Aircraft Authority is not obligated to adjudicate legal title disputes.
8. AIRCRAFT HISTORY REPORTS
Aircraft Authority may provide Aircraft History Reports and similar products containing available information concerning: aircraft identity, registration, ownership chronology, listings, marketplace activity, configuration, installed equipment, modifications, maintenance-related information, accidents, incidents, damage, historical events, service information, and other aircraft information.
AN AIRCRAFT HISTORY REPORT IS NOT A PRE-PURCHASE INSPECTION, AIRWORTHINESS INSPECTION, TITLE SEARCH, LIEN SEARCH, CERTIFIED APPRAISAL, COMPLETE LOGBOOK REVIEW, MAINTENANCE SIGNOFF, LEGAL OPINION, OR GUARANTEE OF AIRCRAFT HISTORY OR CONDITION.
The absence of an event or condition from an Aircraft History Report does not establish that the event or condition never occurred. This includes the absence of: accidents, incidents, damage, repairs, liens, ownership events, maintenance issues, modifications, discrepancies, corrosion, prior listings, title issues, or other conditions.
Purchasers and other users should conduct independent due diligence appropriate to the transaction.
9. CONFIGURATION, EQUIPMENT, MODIFICATIONS, STCs, ADs, AND SERVICE INFORMATION
Aircraft Authority may provide information concerning: aircraft configuration, installed equipment, engines, propellers, avionics, components, modifications, Supplemental Type Certificates, type certificates, Airworthiness Directives, service bulletins, maintenance requirements, inspections, serial-number applicability, and model applicability.
Applicability can depend upon many factors, including: model, serial number, manufacturing history, installed equipment, configuration, previous modifications, repair history, regulatory approval basis, component serial numbers, and facts not known to Aircraft Authority.
Even when systems identify information as applicable, likely applicable, not applicable, verified, or otherwise categorized, users must independently confirm applicability before making a maintenance, regulatory, installation, purchasing, or operational decision. Aircraft Authority configuration intelligence is not an airworthiness determination or regulatory signoff.
10. AIRCRAFT MAINTENANCE INFORMATION
Aircraft Authority may organize or display maintenance-related information but does not perform the maintenance merely because information concerning it appears on the Platform.
Aircraft Authority does not warrant that: required maintenance was completed, maintenance was completed correctly, a logbook entry is genuine, an inspection was legally sufficient, an aircraft is in compliance with all applicable requirements, a component time is accurate, an AD was properly complied with, or an aircraft may legally be returned to service.
Maintenance determinations must be made by appropriately qualified persons using authoritative information.
11. USER-SUBMITTED INFORMATION
Users may submit: aircraft data, ownership information, maintenance information, records, photographs, listings, reviews, comments, configuration information, provider information, transaction information, and other materials.
You represent and warrant that: (1) You have sufficient rights or authority to submit the User Content. (2) You will not knowingly submit materially false information. (3) You will not knowingly misrepresent aircraft ownership, identity, configuration, maintenance, condition, or transaction information. (4) Your submission will not unlawfully violate the rights of another party. (5) You will not impersonate another person or organization. (6) You will not knowingly provide forged or fraudulently altered records. (7) You will reasonably cooperate in correcting materially inaccurate information you submitted when appropriate.
Subject to our Privacy Policy and applicable law, you grant Aircraft Authority a worldwide, nonexclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, process, analyze, organize, adapt, display, distribute, associate, and create derivative information from User Content as reasonably necessary to operate, secure, improve, promote, and provide the Platform.
By uploading, submitting, posting, or otherwise providing content to Aircraft Authority, you grant Aircraft Authority a worldwide, perpetual, irrevocable to the extent permitted by applicable law, nonexclusive, royalty-free, transferable, and sublicensable license to host, store, reproduce, modify for formatting or presentation, resize, crop, display, distribute, publish, and otherwise use that content in connection with Aircraft Authority, its services, aircraft profiles, search and discovery, marketplace features, reference content, communications, promotion of the platform, and related Aircraft Authority services.
You retain ownership of any copyright or other intellectual property rights you hold in your content. This license does not transfer ownership of your copyright to Aircraft Authority.
12. AIRCRAFT RECORDS AND DOCUMENT STORAGE
Aircraft Authority may allow users to upload: logbook records, invoices, maintenance records, photographs, inspection records, ownership documents, configuration records, transaction documents, and similar information.
Aircraft Authority provides technology for storing and organizing copies of information. Uploading information does not make Aircraft Authority the legally required custodian of original aircraft records.
DO NOT DESTROY REQUIRED ORIGINAL AIRCRAFT RECORDS BECAUSE A COPY HAS BEEN STORED WITH AIRCRAFT AUTHORITY.
Aircraft Authority does not guarantee: permanent storage, uninterrupted availability, authenticity, legal sufficiency, evidentiary admissibility, completeness, or recoverability of uploaded records. Users should retain appropriate independent copies.
13. ARTIFICIAL INTELLIGENCE AND AUTOMATED SYSTEMS
Aircraft Authority may use: artificial intelligence, machine learning, automated extraction, optical or document analysis, classification, entity matching, data normalization, anomaly detection, recommendation systems, summarization, valuation models, and other automated technologies.
Automated systems can make mistakes. AI or automated output may contain: incorrect information, hallucinated information, incorrect associations, omissions, outdated information, inaccurate summaries, incorrect classifications, or faulty conclusions.
AI-generated information is not professional aviation, mechanical, engineering, maintenance, legal, financial, regulatory, insurance, tax, or safety advice. Users are responsible for independently verifying material output before relying upon it.
14. VALUATIONS AND MARKET ESTIMATES
Aircraft Authority may provide: estimated aircraft values, market value ranges, comparable aircraft information, market analytics, pricing recommendations, historical price information, depreciation estimates, or similar information. All such information is informational and constitutes an estimate unless expressly represented otherwise. It is not a certified appraisal.
Aircraft Authority does not guarantee the amount for which an aircraft: will sell, can be purchased, can be financed, can be insured, should be listed, or should be valued for tax, legal, accounting, or other purposes.
Actual value may vary materially based upon factors including: physical condition, engine time, propeller time, component times, maintenance, damage history, equipment, avionics, modifications, paint, interior, records, geography, inspection findings, title, market conditions, and buyer and seller circumstances.
15. MARKETPLACE LISTINGS
Aircraft Authority may enable users to advertise aircraft for: sale, rental, lease, or other permitted transactions.
Unless expressly stated otherwise in a separate agreement, Aircraft Authority is a platform facilitating discovery and interaction between users. Aircraft Authority is not the: seller, purchaser, owner, renter, lessor, lessee, dealer, broker, operator, or guarantor of a listed aircraft merely because the listing appears on Aircraft Authority.
Listing users are responsible for the accuracy and legality of their listings. Aircraft Authority does not guarantee: that an aircraft exists, that a listing is still available, that photographs are current, that specifications are accurate, that the listing party owns or controls the aircraft, that a transaction will occur, aircraft condition, airworthiness, title, absence of liens, insurance, regulatory compliance, or performance by another party.
Users must conduct independent due diligence.
16. AIRCRAFT RENTALS AND LEASES
Aircraft rental and lease arrangements can involve significant: FAA requirements, operational-control questions, insurance obligations, tax consequences, commercial-operation restrictions, contractual obligations, and other regulatory requirements.
Aircraft Authority does not determine whether an arrangement legally constitutes: a rental, a dry lease, a wet lease, a charter, a commercial operation, a time-sharing arrangement, or another regulated arrangement. The parties are responsible for understanding and complying with applicable law. The existence of a listing does not constitute Aircraft Authority approval of the proposed arrangement.
17. TRANSACTIONS BETWEEN USERS
Unless Aircraft Authority expressly agrees otherwise in a separate written agreement, transactions entered into between Platform users are between those parties. Aircraft Authority is not responsible for: performance, nonperformance, deposits, payment disputes, fraud, misrepresentations, aircraft condition, title, liens, delivery, taxes, registration, financing, insurance, inspections, contract breaches, or post-closing disputes.
Aircraft Authority may provide: transaction workflows, transaction rooms, document tools, introductions, verification tools, historical records, third-party integrations, ownership-transfer records, or transaction support without becoming a principal to the underlying transaction. Separate transaction-specific terms may apply.
18. AVIATION PROFESSIONALS AND SERVICE PROVIDERS
Aircraft Authority may display or facilitate discovery of: A&P mechanics, Inspection Authorization holders, repair stations, maintenance facilities, avionics shops, engine shops, propeller shops, brokers, dealers, lenders, insurers, escrow providers, title companies, attorneys, tax professionals, appraisers, flight instructors, flight schools, flying clubs, FBOs, airports, charter providers, aircraft managers, ferry pilots, medical examiners, examiners, and other aviation professionals or businesses.
Appearance, ranking, advertising, verification, or recommendation on Aircraft Authority does not constitute a guarantee of a provider's: licensing, certification, insurance, qualifications, availability, reputation, quality, safety, or performance. Users should independently evaluate providers before engaging them.
19. REVIEWS AND RATINGS
Aircraft Authority may permit reviews, ratings, or other user feedback. Reviews represent the opinions of their authors unless expressly identified otherwise.
Users may not knowingly: submit fake reviews, submit reviews concerning experiences that did not occur, impersonate another reviewer, buy or sell fake reviews, condition undisclosed incentives upon positive sentiment, threaten others to manipulate legitimate reviews, submit materially deceptive testimonials, or use multiple identities to manipulate ratings.
Aircraft Authority may investigate and moderate reviews consistent with applicable law and Platform policies. Aircraft Authority does not guarantee the accuracy of user reviews.
20. THIRD-PARTY CONTENT
The Platform may display information supplied by independent users and third parties. Aircraft Authority does not adopt every third-party statement merely by displaying it. To the fullest extent provided by applicable law, Aircraft Authority retains all protections and defenses available with respect to third-party content.
21. THIRD-PARTY SERVICES AND LINKS
Aircraft Authority may integrate with or link to: government databases, maintenance platforms, flight-management software, maps, payment processors, lenders, insurers, escrow services, title providers, analytics providers, aviation services, external websites, and other third parties.
Aircraft Authority does not control third-party services. Third-party services may have their own: terms, privacy policies, fees, security practices, eligibility requirements, and limitations. Your use of third-party services may be governed by agreements between you and those third parties.
22. ACCOUNT ELIGIBILITY
You must be legally capable of entering into a binding agreement to create an Aircraft Authority account. If you use Aircraft Authority on behalf of: a company, partnership, trust, aircraft owner, aircraft operator, aviation business, organization, or another legal entity, you represent that you have authority to act on behalf of that entity to the extent represented.
23. ACCOUNT SECURITY
You are responsible for maintaining appropriate security over your credentials. You must not knowingly: share credentials with unauthorized persons, circumvent authentication controls, impersonate another account holder, or permit another person to misuse your identity.
Notify Aircraft Authority promptly if you reasonably believe your account has been compromised. Aircraft Authority may implement security controls such as: multifactor authentication, identity verification, login monitoring, fraud detection, rate limiting, and session termination.
24. ACTION-SPECIFIC CERTIFICATIONS
Certain Platform activities may require additional certifications, representations, or agreements. Examples may include: claiming an aircraft, claiming ownership, reporting an ownership transfer, creating an aircraft listing, submitting maintenance information, uploading aircraft records, modifying configuration information, claiming a provider profile, or entering a transaction workflow.
These certifications form part of your agreement with Aircraft Authority with respect to that action. Aircraft Authority may preserve evidence of the certification and associate it with the relevant aircraft, listing, claim, provider, document, or transaction.
25. PROHIBITED CONDUCT
You may not knowingly: submit fraudulent aircraft information, falsely claim aircraft ownership, create fraudulent marketplace listings, forge records, deceptively alter records, falsify maintenance information, materially misrepresent aircraft condition, impersonate another person, circumvent verification systems, manipulate ratings or reviews, manipulate valuation systems, commit fraud, introduce malware, interfere with Platform security, access nonpublic data without authorization, evade access controls, use another person's account without permission, violate another person's intellectual property rights, use the Platform to violate applicable law, conduct unauthorized scraping, conduct unauthorized automated extraction, reproduce substantial protected portions of Aircraft Authority databases, overwhelm Platform infrastructure, probe Platform security without authorization, or help another person do any of the foregoing.
26. AUTOMATED ACCESS, SCRAPING, AND DATA EXTRACTION
Aircraft Authority invests substantial resources in collecting, organizing, normalizing, verifying, associating, and presenting aviation information. Except as expressly authorized by Aircraft Authority, applicable law, or published API terms, you may not use: bots, scrapers, crawlers, extraction software, automated agents, or similar means to systematically obtain substantial portions of protected Platform content or construct a competing database or service from Aircraft Authority's proprietary compilation.
Nothing in this section limits rights that cannot lawfully be restricted. Search engines may access publicly available content in accordance with published crawling instructions and applicable permissions. Aircraft Authority may provide authorized APIs or licensing arrangements separately.
27. DATA CORRECTIONS AND DISPUTES
Aircraft Authority may provide mechanisms to request correction of information. Aircraft Authority may require supporting information before changing: ownership records, verified information, historical events, maintenance information, aircraft configuration, transaction history, government-source information, or other significant records.
Correction of current information does not necessarily require deletion of historically accurate information. Aircraft Authority may preserve prior information when reasonably appropriate for: chronology, provenance, fraud prevention, dispute history, transaction history, platform integrity, or auditability.
28. PLATFORM AVAILABILITY
Aircraft Authority may: add features, remove features, modify features, suspend features, change data sources, limit availability, conduct maintenance, or discontinue portions of the Platform. We do not warrant uninterrupted access. Users should maintain independent copies of information that is critically important to them.
29. FEES, SUBSCRIPTIONS, AND PURCHASES
Certain features may require payment. Applicable: price, subscription period, renewal terms, cancellation terms, transaction fees, and refund rules will be disclosed through the applicable purchase flow or additional terms.
Unless expressly stated otherwise or required by applicable law, fees that have been earned are nonrefundable. Additional product-specific terms may apply.
30. INTELLECTUAL PROPERTY
Aircraft Authority and its licensors retain their respective rights in: software, source code, interfaces, designs, branding, trademarks, original written content, proprietary databases, compilations, taxonomies, normalized datasets, derived analytics, algorithms, valuation systems, intelligence systems, original reports, and other protectable Platform materials.
No ownership interest is transferred to you merely because you access the Platform. Subject to these Terms, Aircraft Authority grants you a limited, revocable, nonexclusive, nontransferable right to use the Platform for its intended purposes.
31. YOUR INTELLECTUAL PROPERTY
You retain ownership of intellectual property rights you already possess in User Content. The license granted under these Terms permits Aircraft Authority to use submitted information as reasonably necessary to provide, operate, improve, protect, and promote the Platform.
This provision does not transfer ownership of your original photographs, documents, or other protected works to Aircraft Authority.
32. COPYRIGHT COMPLAINTS
Aircraft Authority respects intellectual property rights. A copyright owner or authorized representative may provide a legally sufficient notice concerning allegedly infringing material to Aircraft Authority's designated copyright contact.
Aircraft Authority may remove or restrict material and may terminate repeat infringers where appropriate. Contact: service@aircraftauthority.com
33. PRIVACY
Aircraft Authority's collection and use of personal information is described in the Aircraft Authority Privacy Policy. The Privacy Policy is incorporated where applicable for purposes of describing Aircraft Authority's privacy practices, but privacy rights provided by applicable law are not waived merely by using Aircraft Authority.
Where legally required, Aircraft Authority may provide additional privacy choices, notices, or controls.
35. ELECTRONIC COMMUNICATIONS AND AGREEMENTS
You consent to conducting your relationship with Aircraft Authority electronically to the extent permitted by applicable law. Electronic actions may be used as evidence of agreement, including: selecting a checkbox, clicking an acceptance button, electronically signing, completing registration, accepting an action-specific certification, or performing another electronic process clearly designated as acceptance.
Aircraft Authority may maintain evidence concerning acceptance, including: account identifier, applicable document, version, document hash, date and time, IP address, user agent, session identifier, acceptance language, route, related aircraft or transaction, and other appropriate audit information.
36. CHANGES TO THESE TERMS
Aircraft Authority may update these Terms from time to time. Each version may have its own: version number, publication date, effective date, and content record.
When Aircraft Authority determines that changes are material or renewed assent is otherwise appropriate, users may be required to affirmatively accept the updated Terms before continuing to use affected authenticated features. Historical acceptance records may be retained.
Continued anonymous use may remain subject to applicable updated public-use provisions after appropriate notice, to the extent permitted by law.
37. DISCLAIMER OF WARRANTIES
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PLATFORM AND ALL AIRCRAFT INFORMATION, DATA, REPORTS, HISTORY INFORMATION, CONFIGURATION INFORMATION, MAINTENANCE INFORMATION, VALUATIONS, LISTINGS, PROVIDER INFORMATION, TRANSACTION FEATURES, USER CONTENT, AI OUTPUT, AUTOMATED ANALYSIS, RECOMMENDATIONS, TOOLS, AND SERVICES ARE PROVIDED 'AS IS' AND 'AS AVAILABLE.'
AIRCRAFT AUTHORITY DISCLAIMS ALL WARRANTIES TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, AND FITNESS FOR AVIATION OR SAFETY PURPOSES.
AIRCRAFT AUTHORITY DOES NOT WARRANT THAT: THE PLATFORM WILL ALWAYS BE AVAILABLE, INFORMATION WILL BE COMPLETE, INFORMATION WILL BE ACCURATE, INFORMATION WILL BE CURRENT, DATA WILL BE ERROR-FREE, THIRD-PARTY INFORMATION WILL BE AUTHENTIC, AN AIRCRAFT IS AIRWORTHY, A TRANSACTION WILL BE SUCCESSFUL, OR PLATFORM INFORMATION WILL SATISFY ANY PARTICULAR LEGAL, REGULATORY, FINANCIAL, MAINTENANCE, INSURANCE, OR OPERATIONAL REQUIREMENT.
38. ASSUMPTION OF RISK
Aviation and aircraft-related decisions can involve significant risk. Aircraft: ownership, operation, flight, maintenance, repair, modification, purchase, sale, rental, lease, financing, insurance, and transactions can involve substantial financial loss, property damage, personal injury, and death.
You acknowledge that information available through Aircraft Authority cannot eliminate these risks. You remain responsible for: independently evaluating information, obtaining appropriate inspections, obtaining appropriate professional advice, conducting appropriate due diligence, and exercising appropriate aviation judgment.
39. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AIRCRAFT AUTHORITY AND ITS PARENTS, SUBSIDIARIES, AFFILIATES, OWNERS, MEMBERS, MANAGERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, USE, BUSINESS OPPORTUNITY, GOODWILL, AIRCRAFT VALUE, OR BUSINESS INTERRUPTION ARISING OUT OF OR RELATING TO THE PLATFORM OR THESE TERMS.
This includes claims relating to: incorrect aircraft information, omitted information, aircraft history, ownership information, government records, maintenance information, configuration information, modification information, applicability determinations, valuation estimates, marketplace listings, User Content, AI output, automated processing, provider information, third-party services, aircraft transactions, rental or lease arrangements, uploaded records, data loss, security incidents, Platform outages, or reliance upon Platform information.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AIRCRAFT AUTHORITY'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE PLATFORM OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID DIRECTLY TO AIRCRAFT AUTHORITY DURING THE TWELVE MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) $100.
Nothing in these Terms excludes or limits liability that applicable law does not permit to be excluded or limited.
40. INDEMNIFICATION
To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Aircraft Authority and its affiliates, owners, members, managers, officers, directors, employees, contractors, agents, licensors, and service providers from third-party claims, liabilities, damages, judgments, losses, costs, and reasonable attorneys' fees arising out of or relating to: User Content you submit, an aircraft listing you create, an ownership claim you submit, a provider profile you claim, false or misleading information you knowingly or negligently submit, your violation of these Terms, your violation of applicable law, your violation of another person's rights, your unauthorized use of another person's information, your transaction with another user, or your misuse of the Platform.
This provision does not require indemnification to the extent prohibited by applicable law.
41. DISPUTES BETWEEN USERS
Aircraft Authority may facilitate communications between users but is generally not responsible for disputes between: buyers and sellers, owners and claimants, renters and owners, lessors and lessees, customers and providers, aircraft partners, businesses and customers, or other Platform users.
Aircraft Authority may, but is not obligated to, provide dispute-resolution assistance. To the fullest extent permitted by law, Aircraft Authority is not responsible for losses caused by another user's acts or omissions merely because the parties encountered one another through Aircraft Authority.
42. SUSPENSION AND TERMINATION
Aircraft Authority may restrict, suspend, or terminate access when we reasonably believe that a user has: materially violated these Terms, submitted fraudulent information, falsely claimed aircraft ownership, created fraudulent listings, abused other users, compromised Platform security, interfered with Platform operations, violated applicable law, created a meaningful safety or fraud risk, or otherwise materially misused the Platform.
Aircraft Authority may preserve certain information after termination where reasonably necessary for: legal compliance, fraud prevention, litigation or dispute preservation, security, contract records, transaction history, ownership chronology, source provenance, or other legitimate purposes consistent with the Privacy Policy and applicable law.
43. INFORMAL DISPUTE RESOLUTION
Before initiating arbitration, a party asserting a dispute must first provide the other party with a written notice describing: the party's name and contact information, the nature and factual basis of the dispute, and the relief requested.
The parties will attempt in good faith to resolve the matter informally for at least 30 days after receipt of a sufficient notice before initiating arbitration. This requirement does not prevent a party from seeking emergency or temporary equitable relief when reasonably necessary to prevent immediate harm.

44. AGREEMENT TO BINDING INDIVIDUAL ARBITRATION
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Except for disputes expressly excluded below and to the maximum extent permitted by applicable law, you and Aircraft Authority agree that disputes, claims, or controversies arising from or relating to: these Terms, the Platform, an Aircraft Authority product or service, your account, your relationship with Aircraft Authority, or a transaction between you and Aircraft Authority will be resolved through binding individual arbitration rather than litigation in court.
The arbitration will be administered by the American Arbitration Association (AAA) under the applicable AAA rules in effect when arbitration is initiated, subject to these Terms and applicable law. The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement to the extent applicable.
Judgment on an arbitration award may be entered in a court of competent jurisdiction.
45. ARBITRATION EXCEPTIONS
The arbitration requirement does not prevent either party from: (1) Bringing an eligible individual claim in small claims court; (2) Seeking temporary or emergency equitable relief from a court where reasonably necessary to prevent immediate unauthorized access, misuse of data, fraud, infringement, or other irreparable harm; (3) Bringing a claim primarily concerning infringement or misappropriation of intellectual property where court relief is appropriate; or (4) Exercising rights that applicable law prohibits the parties from requiring to be arbitrated.
46. ARBITRATION OPT-OUT
If you are a new user accepting these Terms for the first time, you may opt out of the arbitration agreement by sending Aircraft Authority written notice within 30 days after the date you first accept these Terms.
Your notice must: state your full name, identify the email address associated with your Aircraft Authority account, and clearly state that you are opting out of the Aircraft Authority arbitration agreement. Send the notice to: service@aircraftauthority.com
Opting out of arbitration will not terminate your Aircraft Authority account or otherwise affect your use of the Platform. Opting out of a later Terms version does not retroactively alter an arbitration agreement previously entered into unless required by applicable law or expressly stated by Aircraft Authority.
47. CLASS ACTION AND REPRESENTATIVE ACTION WAIVER
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AND AIRCRAFT AUTHORITY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN A PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, MASS, PRIVATE-ATTORNEY-GENERAL, OR REPRESENTATIVE PROCEEDING.
An arbitrator may award relief only to the individual party seeking relief and only to the extent necessary to resolve that party's individual claim, except where applicable law requires otherwise. If a final judicial determination holds that a particular claim or request for relief cannot lawfully be subject to this waiver, that particular claim or request may proceed as required by law, while enforceable portions of this arbitration agreement remain effective to the extent legally permitted.
48. JURY TRIAL WAIVER
For any dispute that is properly resolved in court rather than arbitration: YOU AND AIRCRAFT AUTHORITY KNOWINGLY WAIVE THE RIGHT TO A TRIAL BY JURY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.
49. GOVERNING LAW
Except where the Federal Arbitration Act or another federal law governs, and except where applicable law provides a nonwaivable rule to the contrary, these Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles.
For disputes properly proceeding in court, the parties consent to jurisdiction and venue in the applicable state or federal courts serving Washington County, Utah, unless applicable law requires another forum.
50. EXPORT AND LEGAL COMPLIANCE
You are responsible for using Aircraft Authority in compliance with applicable laws. You may not use the Platform when doing so would violate applicable: sanctions, export-control laws, trade restrictions, or other legal prohibitions.
51. NO PROFESSIONAL RELATIONSHIP
Use of Aircraft Authority does not by itself create: an attorney-client relationship, mechanic-client relationship, broker-client relationship, fiduciary relationship, lender-borrower relationship, insurer-insured relationship, escrow relationship, agency relationship, partnership, joint venture, or employment relationship between you and Aircraft Authority.
52. NO WAIVER
Aircraft Authority's failure to enforce a provision of these Terms does not waive the right to enforce that provision later.
53. SEVERABILITY
If a provision is determined to be invalid or unenforceable, it will be enforced to the maximum extent permitted or severed to the minimum extent necessary, and the remaining provisions will continue in effect, except where applicable law requires otherwise.
54. ASSIGNMENT
You may not assign these Terms or your rights under them without Aircraft Authority's prior written consent. Aircraft Authority may assign these Terms in connection with: financing, corporate restructuring, merger, acquisition, reorganization, sale of assets, change of control, or transfer of the Platform or relevant business.
55. ENTIRE AGREEMENT
These Terms, applicable action-specific certifications, the Privacy Policy where incorporated or referenced, and any additional written terms expressly applicable to a particular Aircraft Authority product constitute the applicable agreement between you and Aircraft Authority concerning use of the Platform.
Separate agreements may govern specific: marketplace transactions, purchases, subscriptions, escrow arrangements, financing relationships, provider relationships, or aircraft transactions.
56. SURVIVAL
Provisions that by their nature should survive termination will survive, including provisions concerning: intellectual property, licenses, historical records, provenance, warranty disclaimers, assumption of risk, limitation of liability, indemnification, dispute resolution, arbitration, governing law, and legally appropriate retention of acceptance and transaction records.
The licenses granted for user-submitted content survive account closure or termination, unclaiming an aircraft, transfer or sale of an aircraft, and ordinary requests to remove content, except where applicable law requires otherwise or Aircraft Authority expressly agrees otherwise.

AIRCRAFT AUTHORITY IS AN AVIATION INFORMATION AND TECHNOLOGY PLATFORM. AIRCRAFT AUTHORITY INFORMATION MAY BE INCOMPLETE, DELAYED, ESTIMATED, DERIVED, OR INCORRECT.
AIRCRAFT AUTHORITY INFORMATION MUST NOT BE USED AS A SUBSTITUTE FOR REQUIRED AIRCRAFT RECORDS, AUTHORITATIVE FAA INFORMATION, REQUIRED INSPECTIONS, QUALIFIED MAINTENANCE PERSONNEL, AIRWORTHINESS DETERMINATIONS, PRE-PURCHASE INSPECTIONS, TITLE OR LIEN SEARCHES, LEGAL ADVICE, FINANCIAL ADVICE, INSURANCE ADVICE, OR PILOT-IN-COMMAND JUDGMENT.
USERS REMAIN RESPONSIBLE FOR INDEPENDENTLY VERIFYING INFORMATION BEFORE MAKING ANY DECISION THAT COULD AFFECT THE OWNERSHIP, OPERATION, MAINTENANCE, CONFIGURATION, PURCHASE, SALE, RENTAL, LEASE, VALUE, INSURANCE, FINANCING, OR SAFETY OF AN AIRCRAFT.
